Crypto tax in the Netherlands (2026): no tax on selling, a tax on holding
The Netherlands does not tax your disposal at all. It charges a deemed return on what you held at midnight on 1 January, whether or not you ever sell — which turns the whole question from what you did during the year into what you owned on one particular morning.

| Tax rate | Box 3: a deemed return of 6.00% on investments and other assets, taxed at 36% for 2026. Bank deposits are deemed at 1.28% and debts at 2.70%.1 |
| What triggers tax | Nothing you do during the year. Only the 1 January balance counts — not a sale, not a swap, not a hundred trades.2 |
| Tax-free capital | €59,357 per person for 2026, €118,714 for fiscal partners. (2025: €57,684 and €115,368.)1 |
| Valuation | The value in economic traffic at 1 January, 00:00, at the rate on the platform you use.2 |
| Declaring | The aangifte inkomstenbelasting, box 3. From tax year 2025 there is a distinct 'Cryptobezittingen' category — before that crypto went under 'Overige bezittingen'. The return is due by the date in your assessment letter, usually 1 May; an extension can be requested.2 Unverified: the deadline that applies where a tax agent files under the becon scheme was not confirmed for the 2025 return |
| When it leaves box 3 | Mining at a profit, or activity involving labour beyond ordinary investing, moves to box 1 at ordinary rates. Crypto received as pay is wage in kind.2 |
| Who knows | Council Directive (EU) 2023/2226 — transposition due 31 December 2025, obligations apply from 1 January 2026, and the first exchange of information covering 2026 takes place by 30 September 2027. The Netherlands is on the OECD CARF list for 2027.3 |

Why your records — not the rules — are the real problem
Under the counter-evidence rule you may elect to be taxed on your actual return instead of the deemed one — and actual return includes unrealised falls in value. But a negative year is set to zero and cannot be carried into another year.
A deemed-return system rewards a completely different discipline from a realisation system. Nobody needs your trade history — they need a defensible valuation of everything you held on one morning, including the wallet you forgot. That is a different kind of hard.
That is the gap ClearBasis closes: we rebuild the complete acquisition history from exchange files and on-chain records, match every transfer between your own wallets so moving coins is never taxed as selling, and attach evidence to every number.
A verzuimboete of €469 for not filing or filing late, rising to €6,709 for repeated default; a payment default penalty of 5% with a €50 minimum and €6,709 maximum; and a vergrijpboete of 50% of tax deliberately concealed, or 25% for gross negligence.

If I sell at a profit, do I owe Dutch tax on the gain?
Not in box 3. The gain itself is not a taxable event; what matters is the value of what you hold on the next 1 January.
Where does crypto go on the return now?
In box 3, under the Cryptobezittingen category introduced for tax year 2025. Guides written earlier will point you at Overige bezittingen.
Can I use the counter-evidence rule if crypto fell?
You may elect to be taxed on actual return, which includes unrealised falls. But a negative total is set to zero for the year and cannot be carried forward, so it caps your downside at nil rather than producing relief.
